St Jean Creative Photography: Terms and Conditions
Welcome to St Jean Creative Photography! Below you will find our policies, terms, and conditions designed to ensure clarity and understanding of the services we provide. Please read carefully before entering into any agreement with us.
Pricing Policy
We value clear communication. Therefore, all pricing inquiries must be discussed via phone or in-person. This allows us to ensure that every question is answered and that you fully understand the services being offered. We do not provide quotes via text or email alone.
Terms and Conditions
- Exclusive Photographer
St Jean Creative Photography is the sole and exclusive photographer for the services you have requested. We will handle your session with professionalism and care.
- Reservations
Once you sign a contract or make a purchase, your date and time are reserved. A minimum 25% nonrefundable deposit is required to secure your booking. This deposit is nonrefundable unless we can fully replace the reservation. In cases of rescheduling or cancellations (except for bad weather), the deposit will not be returned.
- Weather and Adverse Conditions
If poor weather or other uncontrollable conditions prevent us from delivering quality photos, we may choose to reschedule or change the location to ensure your photos meet our high standards.
- Payment Terms
No part of your order, including previews, will be delivered until the full balance is paid. Payment plans and deadlines will be discussed upon booking.
- Image Use
St Jean Creative Photography reserves the right to use any images from your session for advertising, display, or publication. By signing this contract, you agree to allow the use of the likeness of all persons in the photos. You also agree to defend us from any legal claims related to this. St. Jean Creative and All Star Youth Photography never provide raw files. Raw files are the exlusive property of St Jean Creative and All Star Youth Photography.
- Substitute Photographer
In cases where the assigned photographer is unavailable due to illness or conflict, we may assign another qualified professional photographer to handle your session. Rest assured, the replacement will be a competent professional.
- Limitations on Liability
If we are unable to perform due to unforeseen events such as fire, strike, illness, or acts of God, we will refund your deposit but will not be liable for further damages. This also applies to lost or damaged photos due to camera or processing issues, or postal errors beyond our control.
- Color Disclaimer
The nature of color dyes used in photography may cause images to fade or discolor over time. We are not responsible for any changes in the appearance of your photographs due to these inherent qualities.
- Pricing Adjustments
Our prices are subject to periodic updates. Any future orders will be charged according to the prices in effect at the time the order is placed.
- Copyright Notice
It is illegal to copy, scan, or reproduce our photographs without written permission. Unauthorized reproduction is a violation of federal law and will result in civil and criminal penalties.
- Raw File Policy
Raw files are never for sale or distribution. These unprocessed files are essential to maintaining the quality of our work, and we retain full control over the editing process to ensure the final images meet our professional standards.
- Governing Law
These terms are governed by the laws of the State of Florida.
Image Ownership, Copyright & Usage Policy
St Jean Creative Photography & All Star Youth Photography Florida
This policy applies to all photography services provided by St Jean Creative Photography and All Star Youth Photography Florida (“the Photographer,” “the Studio,” “we,” or “us”).
1. RAW Files & Unedited Images
- We do not provide RAW files, unedited images, or camera-original files under any circumstance.
- All RAW files, original captures, and working files remain the sole property of the Studio.
- The only files delivered to the client are final, edited images selected and prepared at the Studio’s discretion.
2. Copyright Ownership
- All images created by the Studio are protected under United States and international copyright law.
- Copyright remains the exclusive property of the Studio at all times, unless otherwise agreed to in a separate written and signed agreement.
- Purchase of images, prints, digital files, or packages does not transfer copyright to the client.
3. License for Personal Use
When digital files or printed images are purchased, the client receives a non-exclusive, non-transferable license for personal use only. Personal use includes, but is not limited to:
- Displaying prints in your home or office
- Sharing images on personal social media accounts (with no commercial intent)
- Using images in personal photo books, greeting cards, or family keepsakes
When sharing online, we appreciate (but do not require) a credit such as:
“Photo by St Jean Creative Photography” or “Photo by All Star Youth Photography Florida.”
4. Prohibited Uses (Without Written Permission)
The client may not:
- Use images for any commercial purpose, including but not limited to advertising, marketing, product packaging, business websites, or paid sponsorships
- Sell, license, or otherwise distribute images to third parties
- Submit images to contests, publications, or media outlets without prior written permission from the Studio
- Claim the work as their own or remove/alter any copyright notices
Any commercial or extended use must be negotiated under a separate written licensing agreement and may involve additional fees.
Refund & Cancellation Policy
St Jean Creative Photography & All Star Youth Photography Florida
We understand that plans can change. Because we reserve your date and time exclusively for you, cancellations and refunds are handled according to the policy below.
1. Non-Refundable Deposits / Retainers
- All deposits/retainers are nonrefundable.
- The retainer secures your session or event date and covers time spent on planning, communication, and turning away other bookings for that time.
- Unless otherwise stated in a separate written agreement, retainers are never refunded.
2. Why Timing Matters
The closer a cancellation is to the scheduled session or event date, the harder it is for us to fill that time with another client. For this reason, refunds (when applicable) are prorated based on how far in advance the cancellation request is made.
3. Eligibility for Refunds
- Refunds are only considered for sessions or events canceled at least 30 days in advance of the scheduled date.
- Completed services and delivered products (including prints, albums, digital files, or other finished work) are not eligible for refunds.
- Deposits/retainers are nonrefundable, unless otherwise stated in a separate written and signed agreement.
4. Cancellation Deadlines & Prorated Refunds
All cancellation requests must be submitted in writing (email is acceptable).
Refund eligibility for payments beyond the nonrefundable retainer is as follows:
- 90+ days before the session/event date
- Eligible for a refund of 75% of payments made beyond the nonrefundable retainer.
- 60–89 days before the session/event date
- Eligible for a refund of 50% of payments made beyond the nonrefundable retainer.
- 30–59 days before the session/event date
- Eligible for a refund of 25% of payments made beyond the nonrefundable retainer.
- Less than 30 days before the session/event date
- No refunds are available. At this stage, it is extremely difficult to rebook the date, and staffing, planning, and other costs have already been incurred.

5. Evaluation Process
- We will evaluate all refund requests based on:
- Services already provided
- Time reserved
- Any nonrefundable fees (such as location permits, props, rentals, travel, or third-party vendor costs)
- Prorated refunds will reflect only the portion of services not yet rendered and exclude the nonrefundable retainer.
- We may request additional information in order to review and process your refund request properly.
6. Refund Method
- Approved refunds will be processed within 30 days of written approval.
- Refunds will be issued using the same method as the original payment, unless otherwise agreed in writing.
- We are not responsible for any processing fees, currency conversion fees, or delays imposed by your bank, credit card company, or payment provider.
7. Alternative Solutions (Rescheduling & Credits)
For cancellations that fall within a non-refundable period, we may, at our discretion, offer:
- Rescheduling your session to another available date, and/or
- Applying a partial or full credit of your nonrefundable payments toward a future session or event
Any reschedule or credit is subject to availability and must be confirmed in writing. Pricing for future dates may be subject to change.
8. Exceptional Circumstances
We recognize that true emergencies and situations beyond your control can occur (for example, serious illness, hospitalization, natural disasters, etc.).
- In the case of emergencies or extraordinary circumstances, we may, at our sole discretion, adjust the application of this policy to reach a fair solution for all parties.
- Any exceptions granted are case-by-case and do not establish a precedent for future bookings.
